A person charged with operating a motor vehicle under the influence of alcohol or drugs, who refused to submit to a chemical test may be required to complete a mandatory evaluation. This evaluation must be completed by an approved provider by the Office of Alcoholism and Substance Abuse Services (OASAS) who is a licensed professional.
According to New York State Guidelines, the evaluation process will take approximately two hours, held in one session as determined by the evaluator. The evaluation process includes obtaining a personal history, a health history, an alcohol and substance abuse history, a collateral interview, contact with referral sources, a urine and breath test, and a written report.
Upon completion of the evaluation, a report will be written, discussed with the client, and submitted which will include evaluations results and treatment recommendations with referrals if needed.
